第1条（適用）
本規約は、RNA.inc（以下「当方」といいます）が提供するウェブアプリケーション「FitChord」（以下「本サービス」といいます）の利用に関する条件を定めるものです。利用者は、本規約に同意の上、本サービスを利用するものとします。

第2条（定義）
本規約において、次の各号の用語は、それぞれ次の意味を有します。
（1）「利用者」とは、本サービスを利用するすべての者をいいます。
（2）「コンテンツ」とは、本サービスを通じて当方又は利用者が送信・表示する情報をいいます。
（3）「登録利用者」とは、アカウントを作成した利用者をいいます。

第3条（本サービスの内容）
本サービスは、利用者がアップロードした画像等の情報をもとに、肌色・質感・体型等に関する分析結果を表示し、衣服の色・素材・シルエット等に関する参考情報を提供するものです。本サービスは医療行為、診断、治療、美容医療の助言を目的とするものではありません。

第4条（アカウント）
登録利用者は、当方の定める方法により真実かつ正確な情報を登録するものとします。
利用者は、自己の責任においてアカウント情報を管理し、第三者に利用させてはなりません。
当方は、本規約に違反した場合、事前の通知なくアカウントを停止又は削除できるものとします。

第5条（利用料金）
利用者は、当方が指定する決済手段および手続により、サブスクリプションを申し込むことができます。
サブスクリプションの解約は、当方がウェブサイト上で案内する解約手続により行うものとします。解約手続を完了した場合、当該請求期間の満了時点をもってサブスクリプションは終了し、以降の更新課金は行われないものとします。なお、当該請求期間が終了するまでの間、当方が定める範囲で本サービスを利用できる場合があります。
利用者アカウント（メールアドレス・パスワード等により当社が識別する利用者の地位）と、サブスクリプションに基づく利用権は別個のものとし、サブスクリプションを解約した場合であっても、利用者アカウントが自動的に消滅するものではありません。 利用者は、当方の定める方法により、再度サブスクリプションを申し込むことができます。
当方は、解約に関し、利用者から解約理由等の情報を取得する場合があります。

第6条（禁止事項）
利用者は、次の各号の行為をしてはなりません。
（1）法令又は公序良俗に違反する行為
（2）当方又は第三者の権利を侵害する行為
（3）本サービスの運営を妨害する行為、不正アクセス、リバースエンジニアリング等
（4）他人の肖像を無断でアップロードする行為その他、第三者の個人情報を不当に取り扱う行為
（5）その他、当方が不適切と判断する行為

第7条（知的財産権）
本サービスに関するソフトウェア、デザイン、商標、テキスト等に関する知的財産権は、当方又は正当な権利者に帰属します。利用者は、本サービスを通じて提供される分析結果等を、私的利用の範囲を超えて複製・頒布・貸与等してはなりません（当方が別途許諾した場合を除きます）。

第8条（免責）
本サービスは現状有姿で提供されるものであり、分析結果の正確性、完全性、特定の目的への適合性について、当方は保証しません。
利用者が本サービスの利用に関連して被った損害について、当方に故意又は重過失がある場合を除き、当方は賠償責任を負いません。当方が責任を負う場合であっても、その上限は、当該損害が発生した月に利用者が当方に支払った利用料の額（無料の場合は1万円）とします（法令上認められる範囲で定める）。
本サービスの中断、データの消失、第三者との紛争等について、当方は合理的な範囲で対応するよう努めますが、これらにより生じた損害について責任を負わない場合があります。
第9条（サービスの変更・終了）
当方は、利用者への事前通知又は本サービス上での告知により、本サービスの内容を変更し、又は提供を終了することができます。

第10条（規約の変更）
当方は、必要に応じて本規約を変更できます。変更後の規約は、本サービス上に掲示した時点から効力を生じるものとします。重要な変更の場合は、合理的な方法で通知します。

第11条（準拠法・管轄）
本規約は日本法に準拠し、本サービスに関する紛争については、名古屋地方裁判所を第一審の専属的合意管轄裁判所とします。

RNA.inc (“we,” “us,” or “our”) establishes this Privacy Policy regarding the handling of users’ personal information in the application “FitChord” , “FitChord-Color” , “D65er” (the “App” or the “Service”) provided by us.

1. Personal Information We Collect
We may collect the following information in connection with providing the Service:

(1) Account information, such as email address and password hash
(2) Information automatically collected through use of the Service, such as access logs, device information, and IP address
(3) Details of inquiries submitted by users

Face and eye images are handled separately as described in the sections below.

2. Face Data Collected by the App
The App may temporarily use a face image and, where applicable, a close-up image of the eye/iris area that the user voluntarily captures, uploads, or selects.

These images are used only locally within the App on the user’s device, using the App’s WebView/browser runtime memory, for skin color component analysis, including skin color, brightness, hue, saturation, contrast, and complexion-related color characteristics.

The App does not collect, create, or store faceprints, facial recognition templates, biometric identifiers, facial geometry data, identity verification data, or any data used to identify or authenticate a person.

Face and eye images are not uploaded to, transmitted to, or stored on any server or cloud environment.

3. Purpose of Use of Face Data
The purpose of using face and eye images is to analyze skin color components and provide color recommendations, including colors that may make the user’s skin appear brighter and colors that may make the user’s complexion or blood tone appear healthier.

The analysis result is used only to display color recommendations to the user within the App.

Face data is not used for facial recognition, identity verification, authentication, tracking, advertising, profiling, model training, analytics, or any purpose unrelated to the color recommendation feature.

Face data is not used for any purpose other than the skin color component analysis and the resulting color recommendation described above.

4. Storage and Processing of Face Data
Face and eye images are processed locally within the App on the user’s device, using the App’s WebView/browser runtime memory.

Face and eye images are not uploaded to, transmitted to, or stored on our servers, cloud storage, databases, analytics tools, advertising networks, third-party services, or any other external environment.

The App does not store face or eye images on our servers, in cloud storage, in a database, or in any persistent storage controlled by us.

5. Sharing and Disclosure of Face Data
We do not share face data with any third parties.

Face and eye images are not sent to external servers, third-party services, cloud storage, analytics tools, advertising networks, or any other external party.

We do not disclose, sell, rent, or otherwise provide face data to any third party.

6. Retention Period of Face Data
Face data is retained only temporarily while the analysis is being performed locally within the App on the user’s device.

The App does not retain face or eye images after the analysis session.

The data is cleared when the user closes or restarts the App, navigates away from the analysis screen, or replaces/removes the selected image.

Because face data is not transmitted to or stored on our servers or cloud services, there is no server-side retention period for face data.

7. Method of Collection
We collect the information described in Section 1 through user input, use of the App, technical means, inquiry forms, and other similar methods.

Face and eye images are voluntarily captured, uploaded, or selected by the user and are processed only as described in Sections 2 through 6.

8. Purpose of Use of Personal Information
We use the personal information we collect for the following purposes:

(1) To provide the Service, verify user identity, and respond to support requests
(2) To improve the quality of the Service, prevent unauthorized use, and conduct statistical analysis, provided that such analysis may be conducted only after processing the information into a form that cannot identify individuals
(3) To bill usage fees and contact users regarding payments, if the Service is offered for a fee
(4) To send notices, where necessary, with user consent or by providing an opt-out method
(5) To respond to legal requirements

Face data is used only for the purposes described in Section 3.

9. Provision to Third Parties
We do not provide personal information to third parties except in the following cases:

(1) When the user has given consent
(2) When required by law
(3) When necessary to protect a person’s life, body, or property, and it is difficult to obtain the user’s consent
(4) When we outsource part of our operations, such as cloud hosting or payment processing. In such cases, we will exercise necessary and appropriate supervision over the service providers.

Face data is not shared with third parties, as described in Section 5.

10. International Transfer
If our servers or service providers are located outside Japan, we will take necessary measures in accordance with the Act on the Protection of Personal Information and other applicable laws and regulations.

Face data is not uploaded to or stored on our servers or cloud services and is not subject to server-side international transfer by us.

11. Security Measures
We take reasonable organizational, personnel, physical, and technical measures to prevent leakage, loss, or damage of personal information and to otherwise ensure the secure management of personal information.

Face and eye images are processed locally within the App on the user’s device and are not stored on our servers or cloud services.

12. Retention Period of Personal Information
We retain personal information for the period necessary to achieve the purposes of use, and after that period has passed, we will delete or anonymize the information in accordance with applicable laws and regulations.

The retention period of face data is described separately in Section 6.

13. Disclosure, Correction, Suspension of Use, etc.
Users may request disclosure, correction, addition, deletion, suspension of use, or suspension of provision to third parties regarding their own personal information held by us. To make such a request, please contact the inquiry desk listed at the end of this Policy. After verifying the user’s identity, we will respond within a reasonable period of time.

14. Cookies and Similar Technologies
We may use technical information such as cookies, device information, and access logs to improve the convenience of the Service, analyze usage, and identify issues. Users may be able to restrict some of these technologies through the settings of their device or browser.

Face data is not used for tracking, advertising, profiling, analytics, or model training.

15. Minors
If a minor uses the Service, the minor must use the Service with the consent of a parent or legal guardian.

16. Changes to This Policy
We may change this Policy in response to amendments to laws and regulations or business needs. The revised Policy will become effective when posted within the Service or by any other method we deem appropriate.
